1. Terms of Service

Welcome to Flip. By accessing or using our marketplace, you agree to comply with and be bound by these Terms of Service. Please review them carefully. If you do not agree to these terms, you should not use this site. These terms govern all transactions and interactions on our platform.

User Accounts

• Users must be at least 18 years old to create an account and transact on the platform.
• You are responsible for maintaining the confidentiality of your account and password.
• You agree to notify us immediately of any unauthorized use of your account.
• You may not use another person's account without permission.
• We reserve the right to suspend or terminate accounts that violate our policies.

Seller Obligations

• Sellers must accurately describe items, including condition and any defects.
• All items listed must be in the seller's possession and legally able to be sold.
• Sellers are responsible for shipping items promptly and securely.
• Sellers must honor the price and terms stated in their listings.
• Sellers may not engage in price manipulation or bid shilling.

Buyer Obligations

• Buyers must make timely payments for purchased items.
• Buyers agree to inspect items upon receipt and report any discrepancies or issues within 48 hours of delivery.
• Buyers must not make false claims about items received.

Platform Commission

Flip collects a flat 7% commission on the sale price of each sold item (excluding shipping costs). This commission applies equally to all sellers and is automatically calculated and deducted from the seller's payout. There are no monthly fees, subscription tiers, or upfront costs — only the 7% commission when a sale is made.

Payments & Payouts

Payments for all items are automatically released to Sellers three (3) days after delivery, unless a return or dispute is initiated by a buyer. In that case funds will be held until a resolution is reached.

Returns

If a return is requested, Buyer pays return shipping unless an item was grossly misrepresented or unless a Seller states in the related listing they offer free returns.

2. Prohibited Items Policy

To ensure the safety and legality of our marketplace, Flip strictly prohibits the listing or sale of certain items. Any listing found to violate this policy will be removed immediately. Repeat violations may lead to account suspension or permanent termination.

Strictly Prohibited Categories:

• Illegal Items: Any items whose sale, distribution, or possession is prohibited by federal, state, or local law.
• Drugs & Drug Paraphernalia: Illegal drugs, controlled substances, narcotics, prescription medications, and any items primarily intended or designed for making, administering, or consuming illegal drugs (pipes, bongs, syringes, etc.).
• Firearms & Ammunition:

  Firearms cannot be listed on Flip due to strict federal, state, and international laws banning the sale of these items.

  The following are not allowed under any circumstances:

  • Firearms of any type
  • Parts and accessories for assault weapons, including blueprints and instructions
  • Any part or accessory not following local law
  • Firearm receivers, even if incomplete
  • Ammunition for firearms, including bullets, cartridges, casings, shells, and hulls

  The following firearm accessories are not allowed:

  Frames, kits used to create a firearm, polymer 80 frame kits, flash suppressors, silencers, sears, high capacity magazines that accept more than 10 rounds (even if they have been modified to accept fewer), magazine extenders, bump fire stocks, grenade launchers, and pistol conversion kits

  The following accessories for semiautomatic pistols are not allowed:

  Barrel shrouds, forward pistol grips, and threaded barrels

  All listed items of any type must comply with California state law.

• Other Weapons: Knives (except standard kitchen cutlery), explosives, dangerous chemicals, tasers, pepper spray, and any item designed to inflict harm or be used as a weapon.
• Human Remains & Body Parts: Any human or animal remains, body parts, organs, blood, biological samples, or related items.
• Nudity & Sexually Explicit Material: Pornography, explicit adult material, sex toys, or any content depicting nudity or sexual acts.
• Counterfeit & Replica Items: Fake designer goods, pirated media, bootleg merchandise, or any items that infringe on intellectual property rights, trademarks, or copyrights.
• Hazardous Materials: Flammable liquids or gases, toxic chemicals, radioactive materials, corrosive substances, asbestos, or any hazardous waste.
• Live Animals & Protected Wildlife: Live animals (except certain fish and invertebrates with proper permits), endangered species, or products made from protected wildlife (ivory, tortoiseshell, certain furs, etc.).
• Stolen Goods: Any items obtained illegally or without proper ownership documentation.
• Medical Devices & Prescription Drugs: Prescription medications, medical devices requiring FDA approval or a prescription, unapproved medical treatments, or healthcare items requiring professional licensing.
• Holistic & Other Medications and Body Products: CBD and/or any other regulated product which requires specific labeling and approval by the FDA or any other government agency.
• Hate Speech & Discriminatory Items: Items that promote hatred, violence, or discrimination against any group or individual based on race, religion, gender, sexual orientation, disability, or any other protected characteristic.
• Personal Information & Identity Documents: Any sale or exchange of personal data, social security cards, passports, driver's licenses, credit card information, or other identity documents.
• Gambling & Lottery Items: Lottery tickets, casino chips (unless collectible and clearly stated as non-redeemable), slot machines, or products/services related to illegal gambling.
• Tobacco & Vaping Products: Cigarettes, cigars, chewing tobacco, e-cigarettes, vape pens, or vaping liquids.
• Alcohol: Beer, wine, spirits, or any alcoholic beverages.
• Services: Our platform is for physical goods only; services, digital downloads, and intangible items are not permitted.
• Recalled Items: Any products that have been recalled by manufacturers or regulatory agencies.
• Lock-Picking Tools & Surveillance Equipment: Professional lock-picking sets, spy cameras, GPS trackers, or equipment designed for illegal surveillance.

Note: This list is not exhaustive and may be updated periodically. Flip reserves the right to remove any listing it deems inappropriate, unsafe, or in violation of its policies, even if not explicitly listed above. When in doubt, please contact our support team before listing an item.

3. Dispute Resolution

In the event of a dispute between buyers and sellers, we encourage both parties to communicate directly to resolve the issue. If a resolution cannot be reached:

• Contact our support team with details of the dispute.
• Provide any relevant documentation (photos, messages, receipts).
• We will review the case and may provide mediation assistance.
• Our decision in disputes is final and binding.

In the event a Dispute is filed by either a Seller or a Buyer and the two cannot work it out, a Flip Admin will step in to arbitrate until a resolution is reached. Listing photos, listing descriptions, banking transactions, ship time and delivery receipt will be examined to determine an appropriate resolution.

Our Privacy Policy describes how we collect, use, and share your personal information. By using our services, you consent to the practices described in this policy.

Flip provides a platform for buyers and sellers to connect but does not endorse any specific listings or sellers. We are not responsible for:

• The quality, safety, or legality of items advertised
• The truth or accuracy of listings
• The ability of sellers to sell items or buyers to pay for items
• Any disputes, damages, or losses arising from transactions
• Shipping delays, lost packages, or damaged items in transit

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. To the fullest extent permitted by law, Flip disclaims all warranties and shall not be liable for any indirect, incidental, or consequential damages.

7. Intellectual Property

All content on Flip, including logos, text, graphics, and software, is the property of Flip or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without written permission.

8. Changes to These Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to the site. Your continued use of the platform after changes are posted constitutes acceptance of the modified terms.
